Fatou Bensouda said in a statement that “I believe war crimes have been committed in the East Jerusalem and Gaza Strip, including on the West Bank.” She said that at the request of Palestine, she could launch a direct investigation. It does not require the approval of the judiciary. The Palestinian Foreign Ministry welcomed International Criminal Court Chief Prosecutor Fatou Bensouda on Friday announcing that it plans to open war crimes investigations in Palestinian territories.

In contrast, Israeli Prime Minister Benjamin Netanyahu has said that the International Criminal Court does not have the authority to investigate allegations of war crimes in Palestinian territories. They called it a dark day for truth and justice. Netanyahu added in a statement that the court has no jurisdiction over the matter. The court only has the power to hear requests from sovereign states, but the Palestinian state is not sovereign.
