The Supreme Court has reached the issue of disqualifying the formation of a special court Lahore High Court’s January 13 decision challenged in the Supreme Court. Former President of the High Court Bar Rawalpindi Taufiq Asif challenged the High Court decision. The petition filed in the Supreme Court has requested that the Lahore High Court verdict be declared unconstitutional and void. The petition further stated that the Lahore High Court’s decision to declare the special court deciding a serious treason case against Musharraf should be declared unconstitutional. The petition states that the Lahore High Court did not have a hearing on the petition for the formation of a special court. And the High Court in its decision did not properly interpret Article 6 of the 18th Constitutional Amendment.

Article 6 of the High Court, which has special significance in the Constitution, has been made ineffective. The petition states that Pervez Musharraf has been on the run since 2016. Therefore, in his absence, the trial was ordered. Musharraf was given several opportunities to appear in court. The High Court cannot question the Supreme Court’s decision to stand trial. The Mustafa Ampex case cannot be applied in this case. The text of the petition states that the High Court’s decision seems to have offended the Chief Justice’s advice on setting up a special court.

The High Court judges reversed their own appointment, which ruled out the July 31, 2009 decision. The High Court could not exercise its jurisdiction in the presence of the Supreme Court decision. The High Court has heard the petitions and violated the Constitution. The applicant filed the petition through the Hamid Khan Advocate.
