A legal dispute has arisen between the International Court of Justice and the Libyan government over the death of Saif al-Islam Gaddafi, son of ex-Libyan man Mohammed Gaddafi, wanted by the International Court of Justice (ICC). It is expected by Libya’s public circles and human rights groups that the International Criminal Court, set up in The Hague tomorrow, will soon issue its verdict against Saif al-Qaddafi. Saif al-Islam Gaddafi has been accused of serious human rights abuses during his father’s reign during a riot that broke out in the country. That is why the International Criminal Court has declared Saif-ul-Islam as an advertisement.

The Libyan Ministry of Justice has said that Tripoli will not allow Saif al-Islam Gaddafi to be extradited to an international criminal court and prosecuted outside of Libya. The statement said that the Libyan judiciary itself is independent and that legal action against any citizen is under its jurisdiction. Saif al-Islam’s defense lawyers have filed an appeal in the World Court of Justice saying that the decision to declare Saif-ul-Islam as an advertisement should be withdrawn and the International Court of Justice withdraws the demand for Saif-ul-Islam. The international court is considering this request while on the other hand; the court has also completed the preparation of the final judgment of its already-pending case against Saif al-Islam. The decision will be announced shortly.

In a statement, the Libyan Ministry of Justice says that the Libyan state has absolute sovereignty and our courts are free. Libya’s courts will be the first to open the door to any kind of legal action against a citizen. On the other hand, the International Military Court is constantly insisting that Saif-ul-Islam be presented to the court in accordance with international law. So that the case can be adjourned in cases of serious human rights violations.
