Lahore High Court adjourns hearing till tomorrow (Friday), seeking written reply from Federal Government on the request of PML-N President Shahbaz Sharif to remove Nawaz Sharif from Exit Control List (ECL). A two-member bench, headed by Justice Ali Baqir Najfi, heard the petition of Shahbaz Sharif. During the hearing Shahbaz Sharif’s lawyer Amjad Pervez told the court that the Lahore High Court and Islamabad High Court had sought medical reports of former Prime Minister Nawaz Sharif and both the courts had granted Nawaz Sharif’s bail. He said that the federal government took medical reports and reviewed them carefully.

Justice Ali Baqir Najfi inquired as to what orders the government had made, on which the lawyer said that the government had once given permission to go out and put the conditions along. The court inquired whether Shahbaz Sharif’s name was also in the ECL to which the lawyer stated that Shahbaz Sharif’s name was also in the ECL but the High Court ordered his removal from the ECL. Justice Ali Baqir Najfi asked the petitioner’s counsel whether the name was included in the ECL on the recommendation of the National Accountability Bureau (NAB), do you think that the Lahore High Court has no jurisdiction to remove Nawaz Sharif from the ECL?

Lawyer Amjad Pervez told the court that the Fiqi organization has to remove the name from the ACL. The Lahore High Court has the authority to hear the case as well. He said that Nawaz Sharif not only challenged the government memorandum but also challenged the move to put his name in the ECL. Later, Justice Ali Baqir Najfi summoned Additional Attorney General Ishtiaq A. Khan on the rostrum from the federal government. Federal government lawyer raised objections to petition filed in Lahore High Court he said that the matter was with the Islamabad High Court and he had the authority to hear the case.

Justice Ali Baqir Najfi said it was also observed that a person can approach the court wherever he resides, please tell us which NAB Nawaz Sharif has been named in the ECL. The Additional Attorney General said that all the records are in Islamabad. We ask for the record on which the Lahore High Court sought written reply from the Federal Government till yesterday (Friday 15th November). Court issues notices to Nawaz Sharif’s removal from ECL he postponed the hearing and asked the petitioner’s lawyer whether there is another question, whether Nawaz Sharif wants to go out or not.

On which the counsel of the petitioner Shahbaz Sharif said that I take the instructions and inform the court. Earlier, a petition was filed by the PML-N President Shahbaz Sharif in the Lahore High Court to remove Nawaz Sharif from the ELC. In his petition, Shahbaz Sharif parties the Federal Government, the Ministry of the Interior, the Federal Investigation Agency (FIA) and the Chairman National Accountability Bureau. And it was taken that Nawaz Sharif is going abroad for treatment. The bail has been approved by the Lahore High Court and Islamabad High Court. He said that the federal government requested to be removed from the ECL but the name was not removed from the ECL. He said that conditions were being laid by the government to remove the ECL. The court ordered the federal government to remove Nawaz Sharif from the ECL. Later, Justice Mamun-ul-Rashid Shaikh appointed the petition for hearing.

Government Terms Rejected:

The PML-N rejected the government’s decision on the condition of Nawaz Sharif’s overseas treatment. Reacting to the Federal Minister for Law and Assistant Special Accountability Press Conference, PML-N spokesman Maryam Aurangzeb said that the government’s decision to subject Nawaz Sharif to removal from the Exit Control List (ECL). Is based on prejudice and political retaliation that we reject. He said that all the constitutional and legal requirements have been submitted at the time of bail by Nawaz Sharif and all bail bonds have been submitted, therefore it is an unreasonable decision of the government to subject his name to the ECL. The government cannot be a court.
